Scope of This Privacy Policy

This Privacy Policy applies to the personal information of individuals that we collect, including when you visit our websites acaseforwomen.com, and acaseforjustice.com, as they may be modified, relocated, or redirected from time to time (together, the “Site”), and outlines how we handle personal information and other data collected when you access our the Site. This policy only applies to our website, and not to other websites we may link to or websites maintained by other companies. The links from the Site do not imply that we endorse or have reviewed any third-party websites; we suggest contacting those sites directly for information on their privacy policies.

For purposes of this Privacy Policy, “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.

This Privacy Policy does not apply to the personal information of individuals in their capacity as prospective, current, or former employees for A Case for Women, or to personal information of our business contacts, such as lawyers or corporate representatives or law firms that we work with for purposes of providing services to our clients. This personal information generally is limited to contact details and other limited information necessary to manage our business.

Prohibited Collection from Children Under 18: The services we provide, together with our Site, are all directed to individuals who are at least 18 years old. We do not knowingly collect information from children under 13 years of age without parental consent. If you are under the age of 13, you are not authorized to use our services or the Site. If we learn that a child under 13 has provided personal information, we will delete it promptly.

Attorney Advertising and No Guarantee

This Site constitutes attorney advertising. Submissions may be referred to independent third-party law firms that are solely responsible for providing legal services. Past results do not guarantee similar outcomes.

What Personal Information We Collect

The types of personal information we collect will vary depending upon the reason that you are interacting with us. When you use the Site or contact A Case for Women by email, phone, or other means, the personal information we may collect includes the following:

  • Identifiers: including your name, mailing address, telephone number, e-mail address, signature, photographs, and Social Security, driver’s license, or state identification card.

  • Communications Data: for example, during our communications with you, we collect the content of those communications as well as metadata about those communications (such as date and time of the call or text (SMS or MMS) message and phone number used).
  • User Content: including any personal information or other content you choose to submit in the course of contacting A Case For Women, through the Site or on our social media pages. For example, information you submit that may be relevant to potential claims you may have.

Some of the categories listed above may be considered sensitive personal information (such as health information or demographic information) depending on where you reside. We collect this information only to the extent necessary to provide our services to you, and only if and to the extent permitted by applicable laws. Whenever legally required to do so, we will provide you with additional information and request your consent before collecting your sensitive personal information.

Automated Collection of Information on the Site:

When you browse our Site, we may collect information automatically through cookies and other technologies to help enhance our ability to serve you. For example, we use these technologies to help us to better understand user behavior including for security and fraud prevention purposes, tell us which parts of our Site people have visited, and facilitate our marketing communications and advertising, and to measure the effectiveness of our advertisements and marketing campaigns.

Cookies: Cookies are small files that the Site or our service provider transfers to your computer’s hard drive through your web browser that enables the Site’s or service provider’s systems to recognize your browser and capture and remember certain information. If you are browsing our Site, we may also use cookies or similar mechanisms to help us measure the number of visits, time spent, pages viewed and other statistics about traffic to our Site.

Analytics Providers: We use third parties, such as Google Analytics, to help us understand how individuals access and use the Site, as well as help us understand market trends and popularity of our services. As part of this process, we may incorporate analytics and tracking technologies from these third parties into our own Site, and some of our Communications such as e-mails. Note however that we have taken measures to restrict how these entities use the information collected through the Site. You can learn more about how Google uses this information here.

Web Beacons: We include small graphic images or other web programming code, called web beacons (also known as “pixel tags”, “web bugs” or “clear GIFs”), on the Site. The web beacons are minute graphics with a unique identifier. They are used to track the online movements of Web users. In contrast to cookies, which are stored in a user’s computer hard drive, web beacons are embedded invisibly on web pages and are about the size of the period at the end of this sentence.  Rejecting cookies using browser settings may not stop web beacons from tracking you.

Do Not Track Setting: In some circumstances, we may track your online activities over time and across websites or online services, and may allow service providers to collect the same types of information for the same purposes as we collect your information. Your web browser may have settings that allows you to transmit a “Do Not Track” signal when you visit various websites or use online services. Like many websites, the Site is not designed to respond to “Do Not Track” signals received from browsers. However, our Site honors Global Privacy Control (GPC) signals from your browser. We may collect the user name associated with that your account and any information or content you have permitted the social media platform to share with us, such as your profile picture, and contact information. The information we collect may depend on whether you have an account with a social media platform, and the privacy settings you have with that account, so please review the privacy statement or policy of the applicable social media platform.   • Attorneys we partner with: We may disclose your personal information to attorneys and law firms that we partner with, as part of our services in connecting you with the proper legal representation for any potential claim you may have.
  • Third-Party Service Providers: We may disclose your personal information to third-party service providers under contract with A Case For Women, to help us provide services to you. For example, these service providers may assist us with hosting and operating the Site, administering our email newsletter, or providing other services to you. These service providers authorized to use your personal information only as necessary to provide specific services to A Case for Women and in accordance with our instructions.

How We Protect Your Personal Information

We prioritize the security of your personal information and take steps to protect it. For example, we use TLS encryption to protect the data collection forms on our website. Other steps we take to secure your personal information include limiting access to personal information to essential employees, implementing and maintaining physical, technical, and administrative safeguards against unauthorized access or use, and requiring our third-party service providers to maintain similar protections for personal information we may disclose. However, no system is completely secure, and we cannot guarantee absolute security.

How Long We Retain Your Personal Information

We retain your personal information for the duration of our relationship with you, and as needed to provide services to you (for example, in accordance with the instructions of an attorney whom we connect you with). Unless necessary to comply with legal, administrative, or procedural requirements, for example, a litigation hold, you may contact us directly using the information listed in the “Contact Us” section of this Policy below if you would like to request that we delete your information.

Promotional Communications and Text Messages

Depending on the nature of your relationship with us, A Case for Women, or our trusted service providers on our behalf, may send newsletters, updates, and other promotional email or automated text (SMS) messages about topics we think will be of interest to you. This may also include automated text messages regarding transactional matters relating to your potential claim. We send these communications with your consent, when you provide your email address and/or telephone number to us, and agree to receive these messages. Message and data rates may apply.

At A Case for Women, we respect your privacy and understand that you may not want to receive those communications from us. You can opt out of our newsletter, automated text messages, or other communications at any time, using the following steps:

  • Reply “stop” or “unsubscribe” to any text messages you receive from us;

Please note that after you opt out, we may still send transactional emails or other non-promotional communications to you, such as those related to you receiving services from us or customer service inquiries. However, you will no longer receive promotional or marketing communications, or automated text messages from us.

Managing Your Preferences:

  • Opt-Out of Promotional Messaging: If you would like to stop receiving newsletters, updates, and other promotional communications from us, you may opt out at any time. Depending on the method of communication, you can do this by: (1) clicking the “unsubscribe” link located at the bottom of our emails, replying “stop”, or “unsubscribe” to any text messages you receive from us, or by contacting us directly using the information listed below.

Additional Information for Residents of Certain States

Scope of this Section:

This Section provides additional information for individuals who reside in U.S. states with comprehensive data protection laws (collectively, “Applicable State Privacy Laws”), to the extent that our collection and handling of personal information is subject to these laws. These include residents of Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, and Virginia, as well as any other states with similar laws and regulations, as enacted or amended from time-to-time.

This Section does not apply to the following:

  • Information publicly available from government records or made publicly available by you or with your permission;

Sales and Targeted Advertising:

We do not, and will not, sell your personal information. However, as is common practice among businesses operating online, we may allow third parties to receive information about you for purposes of analyzing and optimizing our services, to personalize your online experience by providing advertisements that are more relevant to you, and for statistical research and analytics. These activities may be defined as using personal information for targeted advertising as defined under Applicable State Privacy Laws.

A Case For Women may disclose the types of personal information described further above as “Internet or Other Electronic Network Activity Information,” to our marketing partners (marketing and analytics partners, including social media platforms). We disclose this personal information in order to deliver marketing messages, tailor advertising on the Site and in other interactions that you have with us while online, and to and help us understand the effectiveness of those marketing and advertising efforts. To be clear however, we do not use sensitive personal information or information you provide about potential claims you may have for targeted advertising.

We understand that targeted advertising isn’t for everybody, and you have options. You may modify your cookies settings as described above in this Policy. Alternatively, you can opt-out of this type of activity using the methods described further below.

Your Privacy Rights:

Subject to any applicable limitations and exceptions, you have the following rights under Applicable State Privacy Laws:

  1. Right to Access/to Know: You have the right to request information about whether we process your personal information, to access that information, and certain details about how we use it.
  2. Right to Know Disclosures: If you are a resident of Maryland or Oregon, you have the right to obtain, at our option, a list of specific third parties to which we have disclosed either your personal information, or any personal information.
  3. Request Correction: You have the right to request that we correct inaccurate personal information that we have collected from or about you, taking into account the nature of the personal information and the purposes of processing the personal information.
  4. Request Deletion: Except for residents of Utah, you have the right to request the deletion of your personal information that we have collected from or about you. If you reside in Utah, you have the right to submit a verifiable request to delete personal information that we have collected from you.
  5. Data Portability: You have the right to request that we provide you, or send to a third party, a copy of your personal information in electronic form that you provided to us.

Except for residents of Utah, you may also have the right to appeal any decision we make in response to a request to exercise privacy rights, by using the methods listed above. We will inform you of any action taken in response to an appeal, along with a written explanation of the reasons for our decision(s), in accordance with Applicable State Privacy Laws.

To exercise your right to opt out of the use of your personal information for purposes of targeted advertising. You may modify your cookies settings using the link within the footer of our website, or use an opt-out preference signal, such as the GPC. How We Will Verify Your Request:

If you submit a request, we match personal information that you provide us against personal information we maintain in our files. The more risk entailed by the request (e.g., a request for specific pieces of personal information), the more items of personal information we may request to verify your identity.  If we cannot verify your identity to a sufficient level of certainty to respond securely to your request, we will let you know promptly and explain why we cannot verify your identity.

Authorized Agents:

You may also authorize someone to make a request on your behalf. To do so, you must provide the agent with written, signed permission to submit privacy right requests on your behalf, or provide a letter from your attorney. The agent or attorney must provide this authorization at the time of request.
